Supreme Court pulls up its registry for not obeying order

NEW DELHI: A Supreme Court bench led by Justice Abhay S Oka on Tuesday expressed its strong displeasure over failure of the SC Registry to bunch together previous orders passed by a court in a case, despite repeated directions.

The SC Registry, headed by Secretary General and who in turn functions under Chief Justice D Y Chandrachud , seems to have not heeded to Justice Oka-led bench's repeated directions to keep previous orders in each case together in the case file to enable the judges to appraise themselves about past directions.

During the hearing of a case relating to Karnataka's plea to sell sand obtained from desilting of ponds , lakes, and rivers during the summer season to prevent these from overflowing during Monsoon, Justice Oka first expressed his angst to his colleague on bench, Justice Ujjal Bhuyan who seldom speaks during the proceedings.

Justice Oka then dictated an order stating that repeated orders of the bench to put on record copies of the orders passed in a case have not been adhered to by the registry. "The present case is a glaring example of the same mistake," the bench said and asked the court-master to give a copy of the order to the secretary general Atul Kurhekar for necessary action.

On Karnataka govt's plea through senior advocates Basava Prabhu Patil and Devadatt Kamat for sale of desilted material sale, the bench said if the material desilted from water bodies and rivers are to be used in govt projects, it would allow it.

However, if the govt wanted to sell it for commercial gain, then it should be done by public auction , the bench said. When the counsels agreed, the bench allowed the auction in a fair and transparent manner and directed that the auction proceeds be deposited in the court.

Putting another onerous condition on the auction to be carried out within a month, the bench directed the area deputy commissioner to certify that fairness and transparency of the auction. The SC said it would pass orders for disbursal of the amount to the state govt after the money was deposited in the court.
